Ok so lets look at this.
3.1 Non-Team Players are players that are not on any current season roster, or those who recently joined a squad that are still on a wait period.
That is your rule as defined by the site. No objection.
3.4 NT players can only be used if there are no other members of the squad present. (Example: A captain cannot choose to use an NT when a member of his squad is in spec.)

And by your explanation:
3.5 explains that NTs are allowed by default (should you need them) until playoffs when refs have to ask if captains want to allow NTs.
The reason 3.5 was implemented if I remember correctly is because some of the lower tier squads come mid season stopped showing enough which is why ultimately we started allowing players to NT by default instead of forcing forfeits and ultimately hurting the league.
So all of that said. An NT is someone still on a wait period, they are allowed only if needed (your words not mine) until playoffs. And 3.5 was only implemented to help squads that do not show enough, meaning that an opposing captain could not decline a team a chance if and only if they did not show enough to play.
You have what is clearly defined as a NT. And the only reason a squad would need an NT and it be allowed would be if you did not have enough online from your eligible roster.
You are picking and choosing which rules you are using even as clearly you laid out with your own definition if you use them all in conjunction you would see they are ineligible UNLESS they NEED an NT. Meaning they had no other eligible players online to play.
