I should proceed with this. Defamation of character is punishable by law. The extent that some people will go to is evident; unfortunately some choose to utilize their time by ways of malicious behavior.

I think you’re confusing the gist of the argument. No one is saying you can’t provide an opinion or use your “right” to freedom of speech. A personal opinion can be defamatory regardless if it comes from your point of view or not. Same reason tabloids get sued all the time for defamatory comments.

Regardless, your so called “dark topic” was found null and void, filled with personal opinion and a motive to spark drama.

And then we get into the whole Gertz analysis of whether or not for this arena Fausto would qualify as a limited purpose public figure and whether or not the violation would require the finding of actual malice on the part of Pistor.

The bar for proving a case of defamation or slander is really, really high which is why no attorney represents themselves as a "Defamation Attorney" as they do with Personal Injury, Criminal Defense, Trusts and Estates, Elder Law, etc.

I dont know anything about it... but saying things like, in my opinion, i think, etc. Is not really defamation, more like saying what you say, as a fact. Instead of, they are this, he did this, he is that, etc. And it leaves the person suing open to getting fucked up. They have to prove it is defamation.
