Actually, if you bring it up when it happens, the ref or someone can ?info the player in question and make a reasonably sound judgment call whether or not the player did actually lag spiked.

If the player forced lag, then it gets a bit trickier. Then it becomes more of a keeping an eye out for a pattern. If a player keeps spiking in losing battles, then once again, it can be reasonably determined there are rule breaking a occurring.
